GENERAL TERMS AND CONDITIONS – HAIRWAXSHOP

Article 1 – Identity of the Business

These General Terms and Conditions apply to all offers, orders and agreements of:

In these General Terms and Conditions, Hairwaxshop is referred to as "Hairwaxshop", "we", "us" or "our". The customer is referred to as "you" or "the customer".

Article 2 – Applicability

  1. These General Terms and Conditions apply to every offer made by Hairwaxshop and to every agreement concluded with Hairwaxshop through the online store, by telephone, email or in any other manner.
  2. By placing an order, the customer agrees to these General Terms and Conditions.
  3. These General Terms and Conditions are available electronically before an order is placed and can be saved by the customer.
  4. If any provision of these General Terms and Conditions is found to be void or voidable, the remaining provisions shall remain fully applicable.
  5. For consumers, all mandatory statutory consumer rights remain fully applicable.

Article 3 – The Offer

  1. Hairwaxshop describes products and offers as completely and accurately as reasonably possible.
  2. The offer states the main characteristics of the product, the price and any additional costs.
  3. Obvious mistakes or errors in an offer do not bind Hairwaxshop.
  4. Images are intended to provide the best possible representation of the product. Minor differences in colour, packaging or design may occur when a manufacturer changes a product.
  5. Offers are valid while stocks last and during the stated promotional period.

Article 4 – The Agreement

  1. The agreement is concluded when the customer places an order and Hairwaxshop electronically confirms the order.
  2. The customer receives an order confirmation after placing the order.
  3. Hairwaxshop may refuse an order or request additional information where there is reasonable cause to do so.
  4. If an ordered product unexpectedly becomes unavailable, the customer will be informed as soon as possible.
  5. If a product cannot be delivered and the customer has already paid for it, the relevant amount will be refunded.

Article 5 – Prices

  1. All consumer prices are stated in euros and include VAT unless otherwise indicated.
  2. Any shipping costs will be shown to the customer before the order is completed.
  3. The price displayed when the order is placed applies to that order.
  4. Obvious pricing errors, for example caused by a technical malfunction or data-entry error, do not bind Hairwaxshop where it should have been clear to the customer that an error had occurred.
  5. Separate prices, discounts or quotations may be agreed with business customers.

Article 6 – Payment

  1. Payment shall be made using the payment methods available during the ordering process.
  2. Hairwaxshop processes an order after payment has been successfully received or confirmed by the payment provider.
  3. If a payment is refused or reversed, Hairwaxshop may suspend the order until payment has been completed.
  4. A different payment period may be agreed in writing with business customers.

Article 7 – Delivery

  1. Hairwaxshop delivers orders to the delivery address provided by the customer.
  2. Orders are processed as soon as reasonably possible. The expected delivery time is stated on the website or during the ordering process.
  3. The actual delivery time may depend on the destination country, carrier and selected shipping method.
  4. If an order is delayed, Hairwaxshop will inform the customer where reasonably possible.
  5. If delivery becomes permanently impossible, the consumer shall have the statutory rights applicable in such circumstances.
  6. In a consumer sale, the risk relating to a product passes to the consumer once the consumer or a third party designated by the consumer has received the product, unless the law provides otherwise.
  7. For business customers, a different point of transfer of risk may be agreed in writing.

Article 8 – Availability and Stock

  1. Hairwaxshop attempts to keep stock information as up to date as possible.
  2. Products displayed as "out of stock" cannot be ordered until they become available again.
  3. If a product nevertheless proves to be unavailable after an order has been placed, the customer will be informed.
  4. Hairwaxshop may offer an alternative product. The customer is not obliged to accept this alternative.

Article 9 – Right of Withdrawal for Consumers

  1. In principle, a consumer has the right to withdraw from an online purchase within 14 days without giving any reason.
  2. The withdrawal period generally begins on the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product.
  3. Where multiple products are delivered separately, the withdrawal period begins in accordance with the applicable statutory rules.
  4. The consumer may exercise the right of withdrawal by sending a clear statement to Hairwaxshop within the withdrawal period, for example by email or through an available online withdrawal function.
  5. The consumer does not have to provide a reason for withdrawal.
  6. Where an online withdrawal function is legally required, it will be made available on the website in accordance with applicable legislation.

Article 10 – Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply where a statutory exception applies.

This may include, among other things:

  1. Products which, for reasons of health protection or hygiene, are unsuitable for return and whose seal has been broken after delivery;
  2. Products which, after delivery, have become inseparably mixed with other products due to their nature;
  3. Products manufactured according to the customer's specifications or clearly intended for a specific customer;
  4. Other products or services for which the law excludes the right of withdrawal.

If an exception applies, the customer will be informed before or during the ordering process.

Article 11 – Returns

  1. Following withdrawal, the consumer must return the product without undue delay and no later than 14 days after the day on which the withdrawal was notified, unless Hairwaxshop collects the product itself.
  2. In principle, the consumer bears the direct costs of returning the product, unless Hairwaxshop has stated in advance that it will bear these costs or the law provides otherwise.
  3. The consumer is only liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
  4. For opened hygiene products, the right of withdrawal may be excluded where the statutory requirements for such exclusion are met.

Article 12 – Refunds

  1. Following a valid withdrawal, Hairwaxshop shall refund payments received in accordance with the applicable statutory rules.
  2. Refunds shall be made using the same payment method used for the original payment, unless the customer expressly agrees to another payment method.
  3. Hairwaxshop may delay the refund until the product has been received back or until the customer provides evidence that the product has been returned, whichever occurs first.
  4. In the event of a complete withdrawal, the original standard delivery costs will also be refunded where legally required.
  5. If the customer has chosen a more expensive delivery method than the cheapest standard delivery option, the difference does not have to be refunded.

Article 13 – Statutory Warranty and Conformity

  1. The consumer is entitled to statutory protection where a product does not conform to the agreement.
  2. A product must have the characteristics that the consumer may reasonably expect based on the agreement.
  3. In the event of a defective product or a product that does not conform to the agreement, the customer may contact Hairwaxshop at info@hairwaxshop.com.
  4. Hairwaxshop will assess the complaint and, where legally required, provide repair, replacement, a price reduction or a refund.
  5. The consumer's statutory rights are not restricted by any additional commercial warranties.

Article 14 – Order Details and Damaged Deliveries

  1. The customer is responsible for correctly entering the delivery address and other order details.
  2. If an incorrectly provided address results in additional costs, Hairwaxshop may charge these costs to the customer to the extent permitted by law.
  3. Customers are advised to check their order upon receipt.
  4. Damage to the packaging or product should be reported to Hairwaxshop as soon as possible, preferably with photographs.
  5. Reporting damage does not limit the consumer's statutory rights.

  1. The complaint should be described as clearly as possible.
  2. Hairwaxshop will endeavour to process complaints within a reasonable period.
  3. Submitting a complaint does not limit the consumer's statutory rights.

Article 16 – Personal Data

  1. Hairwaxshop processes personal data in accordance with its Privacy Policy.
  2. The Privacy Policy is available separately on the website.
  3. Customers are advised to consult the Privacy Policy before placing an order.

Article 17 – Liability

  1. Hairwaxshop is not liable for damage arising solely from circumstances that, under the law, cannot reasonably be attributed to Hairwaxshop.
  2. No provision of these General Terms and Conditions limits liability that cannot legally be excluded or limited under mandatory law.
  3. For consumers, all statutory rights remain fully applicable.
  4. Hairwaxshop is not responsible for damage resulting from the use of a product contrary to its instructions for use, warnings or statutory requirements.

Article 18 – Force Majeure

  1. Hairwaxshop is not obliged to fulfil an obligation where it is prevented from doing so by a circumstance reasonably beyond its control.
  2. Force majeure may include, among other things, disruptions involving carriers, payment providers or internet services, fire, natural disasters, government measures, war, strikes, import or export restrictions and other serious disruptions.
  3. If a force majeure situation continues for an extended period, Hairwaxshop and the customer will seek an appropriate solution.
  4. Consumers' statutory rights remain applicable.

Article 19 – Intellectual Property

  1. All texts, photographs, images, logos, product information and other content on the website are the property of Hairwaxshop or its licensors, unless otherwise stated.
  2. Such content may not be commercially copied, distributed or used without permission to the extent that such use is not permitted by law.

Article 20 – Business Customers

  1. Separate business terms may be agreed with business customers.
  2. A business customer is a customer acting in the course of a profession or business.
  3. The statutory consumer right of withdrawal does not automatically apply to business customers.
  4. Additional agreements may be made with business customers concerning prices, minimum quantities, payment, delivery, returns and warranty.

Article 21 – Applicable Law

  1. Agreements with consumers are governed by Dutch law, insofar as this does not conflict with mandatory law applicable in the country where the consumer resides.
  2. Agreements with business customers are governed by Dutch law unless otherwise agreed in writing.
  3. Disputes shall be submitted to the competent court in accordance with applicable statutory rules.

Article 22 – Amendments to the General Terms and Conditions

  1. Hairwaxshop may amend these General Terms and Conditions where necessary, for example due to changes in legislation, regulations or business operations.
  2. For agreements already concluded, the terms applicable at the time the agreement was concluded shall remain applicable unless the law provides otherwise.
  3. The most recent version will be published on www.hairwaxshop.com.
